Why the rule of law suffers when we have too many laws

Let's start by distinguishing  force and power...real power attracts cooperation; it has little need for force. When a government can’t depend on allegiance and voluntary compliance it must force people to obey. "The American governmental scheme is sliding ever closer towards a pervasive authoritarianism." (click here for more) Ironically, too many laws lead to anarchy.

Government demands submission. The question then becomes: How much and what kind of submission is acceptable? For more on the psychology of submission and obedience (see Milgram Experiment here). A libertarian government would require less submission.


The ‘social contract’ is threatened by authoritarian governments. “Government that governs least governs best”. Yet, government has grown to regulate most aspects of our lives by force.

Power corrupts! Government power is no exception. Politics is all about power - the power to rig the system. Rigging the system is abuse of power.

Wasn’t America supposed to be about limited government? We are far from the republic Franklin and his fellow patriots gave us.

Government makes laws. Laws create privileges for some and steal inalienable rights from others in the process. Laws steal choices. They prohibit and limit choices for some people and make you obey someone else’s choices. It’s like being told where to sit on the bus. Laws make you do things you would not want to do if you were free. Was it meant to be this way? What can be more valuable than choice? What do you have when you have no choice?

We find ourselves warring against each other - - red states and blue; 'them against us'; ‘Left’ vs. ‘Right’; Republicans vs. Democrats. These forces are just about equal. Each seeks to take, keep and expand the power to impose laws on the other. Campaign finance laws not withstanding, both sides spent as if in combat.  Win at all cost! Tons of money, advertising campaigns, phone banks, promises, defections, “Get out the vote” battalions, voter registration shenanigans, vote fraud, hoards of pollsters, and armies of lawyers have become our new political reality. All of that is to get the power to make laws others must obey.

Prohibitions, limitations and mandates now rule us all. Red voters hope to impose their values on the blue and visa versa. Wasn’t the original idea not to be ruled? No matter the outcome, half of the electorate will have gained more power to impose its values at the expense of the other half. Isn’t that expense becoming unbearable and unsustainable for all? Doesn't such adversarial politics cause cracks in the social contract?

  • If government is “of, by and for the people”, why do so many people complain about government?
  • If government is accountable to “We, the People”, why are so many dissatisfied with the results?
  • How can it be both - accountable and in need of reform?
  • Government does *not* work as intended.
  • Why is government 'dysfunctional'? It isn't. It works as interpreted to favor some at the expense of others. Yet they call it The Common Good.
  • It works badly - which explains the general discontent. That's Politics As Usual.

Those who complain about government ought to strive for less of it ... but all they really do is complain about not having enough of it to impose their rule over others. Wasn’t the original idea to not be ruled? No Matter How You Vote, Politicians Don't Represent You. No matter what politicians do many voters will object. Should values be forced on us and choices restricted by any party? Can’t we try to liberate instead of regulate each other? Wasn’t America supposed to be about voluntary agreement instead of forced obedience?

Act or be acted upon domestically and globally.
