Four face felony charges in workers' comp fraud
COLONIE - Four area residents have been accused of
participating in a scheme to commit workers'
compensation fraud.
Arrested Wednesday were Daniel Booth, 31, of Bayberry
Drive in Latham, Miriah S. Nicholas, 21, of Bayberry
Drive in Latham, Arnold Leto Jr., 41, of Swatling Drive
in Latham and Marian Sherman, 51, of Maxwell Drive in
Troy.
All four face felony charges of falsifying business
records and insurance fraud.
Booth is also charged with workers' compensation
fraud. He is accused of fraudulently receiving $18,000
in benefits.
The charges stem from a scheme in which Booth, an
employee at A. Leto Brothers Paving Co. in Latham, was
collecting workers' compensation benefits while
continuing to work for the company, according to
authorities.
Booth's paychecks were issued to his wife, Nicholas,
to further conceal their plan, according to authorities.
Sherman, the paymaster for the paving company, was
charged with insurance fraud and falsifying business
records.
Leto is the owner of A. Leto Brothers Paving Co.
Booth was a paving crew foreman at the company.
The investigation was conducted by the Office of
Workers' Compensation Fraud Inspector General and the
Colonie police.
